Challenge AI Terms of Service

Introduction
These Terms of Service (“Terms”) form a legally binding agreement between you and Chall Tech regarding your use of the website available at chall.ai (the “Website”) and the Chall AI mobile application (the “App”), together with any associated content, tools, features, and functionality (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Use of the Services

  • Registration Obligations: You agree to provide accurate and complete information when registering for the Services.

  • Member Account, Password, and Security: You are responsible for maintaining the confidentiality of your account credentials. Immediately notify us of any unauthorized use of your account.

  • General Practices Regarding Use and Storage: We may enforce data retention limits and storage capacities, and we reserve the right to terminate inactive accounts.

  • Email Notifications: By providing your email address, you consent to receive communications from us regarding your account and the Services.

2. Conditions of Use

  • User Conduct:

    • You are solely responsible for all content you submit (including text, images, videos, etc.).

    • All content must comply with applicable intellectual property, privacy, and other legal requirements.

    Social Media, Messaging, and Challenge Features:

    • Our application enables users to send messages, share content, and participate in interactive challenges. Content shared via these features may be visible to other users. Please avoid sharing sensitive personal information.

  • Additional Restrictions: You agree not to engage in any activities that could harm the Services, such as uploading harmful code, infringing intellectual property, or engaging in abusive behavior.

3. Intellectual Property Rights

  • User-Submitted Content:

    • You retain ownership of your content. However, by submitting content to the Services, you grant Chall AI a worldwide, non-exclusive, royalty-free, transferable license to use, display, reproduce, and distribute your content for any purpose related to the Services.

    • This includes challenges you create and any AI-generated “Generations” produced in connection with those challenges.

4. Subscription Services and Payment Terms

  • Fees and Renewals:

    • Certain features of the Services require a paid subscription (monthly or yearly). By subscribing, you agree to pay all applicable fees, including taxes.

    • Your subscription will automatically renew unless canceled at least 24 hours before the current subscription period ends.

  • Payment Processing:

    • Payments are processed by third-party providers; your payment information is subject to their privacy policies.

  • Refunds:

    • Subscription fees are non-refundable except as required by law.

5. Third-Party Websites and Services

  • The Services may include links to third-party websites or applications. We have no control over these sites and are not responsible for their content or practices.

6. Indemnification

  • You agree to indemnify and hold harmless Chall AI, its affiliates, officers, employees, directors, and agents from any claims, damages, or expenses arising from your use of the Services.

7. Disclaimer of Warranties

  • The Services are provided “AS IS” and “AS AVAILABLE” without any warranties, express or implied.

  • AI-Generated Content:

    • Features powered by OpenAI’s technologies may generate content for informational purposes only. We do not guarantee the accuracy or reliability of such content; you are responsible for verifying its correctness.

8. Limitation of Liability

  • Chall AI’s total liability shall not exceed the greater of $100 or the amount you paid for the Services, and we shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the Services.

9. Dispute Resolution – Binding Arbitration

  • Any dispute arising between you and Chall AI shall be resolved through final and binding individual arbitration in accordance with the procedures outlined herein.

  • By agreeing to these Terms, you waive your right to a trial by jury and to participate in any class or representative action.

10. Termination

  • Chall AI reserves the right to suspend or terminate your account or access to the Services at any time, with or without notice, for any reason. Termination does not affect Chall AI’s rights to content already submitted.

11. General Provisions

  • These Terms, along with our Privacy Policy, constitute the entire agreement between you and Chall AI.

  • These Terms are governed by the laws of the State of California.

  • If any provision is found invalid, the remaining provisions will continue in full force and effect.

By using our application, you also agree to the following:

  • Use of OpenAI Technologies: Certain features (such as group chats, AI responses, and moderation) are powered by OpenAI services. By using these features, you consent to your inputs being processed by OpenAI in accordance with their policies.

  • User Responsibility: You are solely responsible for any content you provide and must comply with our community guidelines.
